Terms of Service

1. Acceptance of Terms

By accessing or using Playoff Pick'Ems ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and Playoff Pick'Ems ("we," "our," or "us"). Please read them carefully.

2. Description of Service

Playoff Pick'Ems is a web-based platform that allows users to create and participate in NFL playoff bracket prediction pools. Users can:

• Create pools and invite friends to join
• Make predictions for NFL playoff games
• Compete on leaderboards based on prediction accuracy
• Track scores and standings throughout the playoffs

3. User Accounts

3.1 Account Creation

To use the Service, you must sign in using Google OAuth. By doing so, you authorize us to access and use certain information from your Google account as described in our Privacy Policy.

3.2 Account Responsibilities

You are responsible for:

• Maintaining the security of your account
• All activities that occur under your account
• Ensuring your account information is accurate
• Notifying us immediately of any unauthorized access

3.3 Account Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this age requirement.

4. Plans and Pricing

4.1 Free Tier

Free accounts can create and manage 1 pool. All core features are available on the free tier.

4.2 Pro Plans

Pro plans provide unlimited pool creation and additional features. Available plans include:

• Season Plan - One-time payment for access during the current NFL playoff season
• Lifetime Plan - One-time payment for permanent access

4.3 Pricing Changes

We reserve the right to modify pricing at any time. Price changes will not affect existing purchases. We will provide reasonable notice of any pricing changes.

5. Payment Terms

5.1 Payment Processing

All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service.

5.2 One-Time Payments

All Pro plan purchases are one-time payments. There are no recurring subscriptions or automatic renewals. Season plans expire at the end of the current NFL playoff season and require a new purchase for subsequent seasons.

5.3 Refunds

All sales are final. Due to the seasonal nature of the NFL playoffs and the immediate access granted upon purchase, refunds are generally not provided. In exceptional circumstances, refund requests may be considered within 7 days of purchase if you have not actively used Pro features.

6. User Content and Conduct

6.1 User Content

You retain ownership of content you create (pool names, display names, etc.). By posting content, you grant us a license to display it as necessary to operate the Service.

6.2 Prohibited Conduct

You agree not to:

• Use the Service for any illegal purpose
• Harass, abuse, or harm other users
• Use offensive, vulgar, or inappropriate display names or pool names
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Create multiple accounts to circumvent free tier limits
• Use automated tools to access the Service without permission
• Impersonate another person or entity

6.3 Content Removal

We reserve the right to remove any content that violates these Terms or that we deem inappropriate, without prior notice.

7. Intellectual Property

The Service, including its design, features, and content (excluding user content), is owned by Playoff Pick'Ems and is protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

8. NFL Disclaimer

Playoff Pick'Ems is not affiliated with, endorsed by, or sponsored by the National Football League (NFL) or any of its teams. NFL team names, logos, and related marks are trademarks of their respective owners. Our use of NFL-related information is for entertainment and informational purposes only.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

We are not responsible for the accuracy of NFL game results, scores, or related data. While we strive to provide accurate information, you acknowledge that errors may occur.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLAYOFF PICK'EMS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Playoff Pick'Ems and its operators from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Dispute Resolution

These Terms shall be governed by the laws of the State of Wyoming, USA, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of Wyoming, and you consent to the jurisdiction of such courts.

13. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately.

You may terminate your account at any time by contacting us. Termination does not entitle you to a refund of any fees paid.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting a notice on the Service or sending an email. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Playoff Pick'Ems regarding the Service.
